Injunction to stop illegal building work on Leicester Road extended until October

During a hearing on Friday (14 May) the Judge renewed the Interim Order to give the Borough Council time to decide the planning application which was submitted after works began.

Fencing and chalet cabins were spotted on the land opposite Hinckley Rugby Club over the early May bank holiday weekend.

The Borough Council successfully applied for and was granted the injunction on 6 May and the council served the injunction to the occupiers on 7 May.

Any new works after the injunction order was served will be in breach of the injunction.  

If building work continues, those responsible can be held in contempt of court and potentially face imprisonment, a fine or the seizure of assets. 

A further hearing date has been scheduled for Friday 14 May 2021 to which the owners/occupiers will be invited to attend.

Leader of Hinckley and Bosworth Borough Council, Stuart Bray said: “I welcome this move. I assure residents that we will take tough action when breaches of planning control occur.”

In addition the council is also seeking to progress prosecution against those who did not comply with the temporary stop notice which was served over the bank holiday weekend (Sunday 2 May) after receiving reports of unauthorised works taking place on Saturday 1 May. 

A planning application has now been submitted for the site.
